Latest NSW Enforcement Actions

The NSW Regulatory Authority under the National Law (Department of Education) has recently updated its enforcement actions list with a number of prosecutions.


Marina Mansour, registered with Little Star FDC Scheme, was prosecuted for breach of section 167(3), National Law. She was convicted at Liverpool Local Court and fined $1000. The breach related to a child knocking over a cup of boiling water resulting in burns to the 13 month old child's foot.


A number of prosecutions related to Ngallingnee Jarjum Tabulam & District Community Preschool. The approved provider was prosecuted for breach of section 165(1), section 174(2)(a), and regulation 168(1). The approved provider was convicted at Casino Local Court and fined $3600. The major breach (s.165) related to a 3 year old child being left on a service bus unsupervised for nearly an hour. In addition, it was found that the approved provider failed to notify the Department of a serious incident within the prescribed time period (s.174(2)(a)) and failed to have policies and procedures in place in relation to the delivery of children to, and collection of children from, a service premises (r.168(1)). In addition, the nominated supervisor was convicted for breach of section 165(2) and fined $600. The Sector website also carried a story on this case.
