Queensland Publishes Regulatory Data

The Queensland Department of Education has started publishing early childhood regulatory data. The information published includes compliance and enforcement data as well as notification and complaint data (by quarter). The publication of this data is welcomed and provides transparency in relation to compliance activity, enforcement actions, and areas of regulatory concern. The data indicates that serious incidents in services continue to increase. It also shows that breaches in relation to section 165 and 167, National Law, continue to make up the top two breaches. Despite this, the Department has only prosecuted one approved provider and cancelled one approval in the last year. In relation to the National Regulations, the most breached regulations in this quarter (to September 2021) are regulations 103 (keeping premises etc. in safe, clean and good repair), 97 (emergency evacuation procedures), and 170 (policies and procedures).

In order to improve compliance with section 165, the Department published some advice to services recently.
