The Queensland Department of Education (Regulatory Authority under the National Law) has published details of two recent prosecutions under the National Law:
Sumyu Investments Pty Ltd was been fined $15,000 (and $1,851.40 in costs) in the Magistrates Court after a 2 year old child in the care of KidCademy Early Learning Centres, Coorparoo, left the premises through an unsecured gate which the child was able to open due to a faulty lock and was missing for about 30 minutes. No conviction was recorded. The approved provider pleaded guilty to four charges relating to sections 165 and 167; Regulations 99 and 103.
Vesta Maudsland Pty Ltd was fined $13,500 (with $1,750 in costs) in the Magistrates Court, with no conviction recorded, after 2 toddlers in the care of Sanctuary Early Learning Adventure, Maudsland, left the service premises through an unsecured gate. Staff at the service were unaware that the children were missing until alerted by a member of the public who saw the children on a footpath outside of the service. The children were returned to the service six minutes after they left. The approved provider pleaded guilty to two charges relating to breaches of sections 165 and 167. This was the same case reported on by the ABC previously (see previous post).
