WA Approved Provider Receives a Financial Penalty for Failure to Supervise Children

In the case of Chief Executive Officer of the Department of Communities and Hadema Holdings Pty Ltd t/a Kids HQ Jacaranda an order was made by the WA State Administrative Tribunal which gave effect to the terms of settlement in relation to a matter brought before the Tribunal by the WA Regulator (Department of Communities). In this case, a two year old child received injuries to their face following an altercation with two other children. A review of CCTV footage from the service revealed that the incident occurred while the children were left unsupervised for a period of up to seven minutes in the sandpit area.

The approved provider was ordered to pay a $12,000 for breach of section 165(1), National Law and $1,500 towards the Department's legal costs.. The Department also issued a media release. There was also a detailed report in WA Today as well.
