G8 Education Ltd, trading as Great Beginnings Gosnells, was ordered to pay $15,000 plus $2000 costs by the West Australian State Administrative Tribunal for contravention of section 165(1), Education and Care Service National Law. It was found that a boy aged four years and nine months was found on the footpath outside the service, at beside a dual carriageway with a 60kmh speed limit. The child left the service premises without educators noticing and was unsupervised for around five to 10 minutes. The full report of the case can be found at the WA Courts website. In a more recent case, the Tribunal ordered Sparrow Group WA Pty Ltd, operators of Sparrow Early Learning Mandurah, to pay $18,500 plus $1,500 costs for breach of section 165. In this case, a member of the public saw several cars stopped on Mandurah Road and observed three to four children near the cars, unsupervised by any adult. They asked one of the children where she was from and she pointed to the Centre. He then walked up to the fence and informed two educators over the fence that he could see that there were some “escapees” from the Centre. He saw the children climb back into the Centre through a gap in the fence. Full details of the case can be found on the WA Courts website.
